Shev Chanderpaul started the day on 167 and took his total to 193 before he was caught by Brophy off the bowling of Patterson.
Keith Barker hit 85 and Neil Carter 40 as Warwicks were all out for 482.
Barker ripped through the Yorkshire openers. Having already taken out both openers in the first innings, he removed Rudolph, Root, Sayers and Pyrah.
Chris Wright was in great form with the ball and the bowler on loan from Essex took five wickets to leave Yorks who are haunted by relegation on 91-9.
Patterson had held out for eleven runs but he was bowled by Neil Carter and the home side were all out for 127 to give Warwicks an innings and 58 points which puts them within three points of the County Championship leaders Lancashire.
