Coventry born Luke McCormick will appear before Fenton Magistrates in Stoke On Trent in the morning, charged with two counts of causing death by dangerous driving and charges of drunk driving and driving with no insurance..
McCormick, returning from the wedding of footballer David Norris in Bolton, had been driving a black Range Rover which is alleged to have been involved in an incident with a Toyota Previa which careered down an embankment on the M6 southbound near junction 16.
Two boys, Aaron and Ben Peak were killed in the incident whilst their father is in a stable but serious condition in a Staffordshire hospital with fractures to his neck and back, broken ribs and bruising and swelling to his lungs.
At a press conference this afternoon, the boys mother said nothing could compensate for the loss she and her husband were feeling. A distressed Mrs Peak had to have the following statement read for her: "Both Phil and I are devastated at the sudden and tragic death of our beautiful boys. "No parent should ever have to go through the nightmare that we have gone through."
Plymouth Argyle for whom McCormick has played since City released him as a youngster, offered their condolences to the Peak family saying in a statement: "They are very much in our thoughts and prayers at this sad time."
